2. The content and guidance provided through TLA STAR are based on Vedic astrology principles and algorithmic assessments. It is hereby expressly stated that TLA STAR and its content are not intended to be a substitute for professional advice, including, without limitation, medical, legal, psychological, financial, therapeutic, educational, career, or other specialized consultation. The guidance provided within TLA STAR is for informational and indicative purposes only and is subject to individual interpretation.
3. By accessing or using TLA STAR, You acknowledge and agree to the following:

1. You are solely responsible and assume all risks for any and all decisions made or actions taken based on the suggestions or information provided by TLA STAR.
2. The Company does not warrant or guarantee any specific outcome or result from the use of TLA STAR. You acknowledge that astrological predictions and interpretations are inherently subjective and uncertain.
3. To the maximum extent permitted under applicable law, the Company, its affiliates, officers, directors, employees, agents, and licensors shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages (including, without limitation, damages for loss of profits, data, use, goodwill, or other intangible losses) arising out of or in any way connected with Your access to or use of, or inability to access or use, TLA STAR, even if the Company has been advised of the possibility of such damages.
4. You acknowledge that the interpretation and use of astrological content are subjective and a matter of personal belief. The Company makes no representations or warranties regarding the accuracy, reliability, or efficacy of any astrological predictions or guidance provided through TLA STAR.
5. The Application and its content are provided on an "AS IS" and "AS AVAILABLE" basis without any warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
6. This Disclaimer shall be governed by and construed in accordance with the laws of India.

Introduction

Welcome to TLA STAR, a mobile application operated by TL Astrologer OPC Private Limited (hereinafter referred to as "the Company").

By accessing or using the TLA STAR mobile application (the “App”) on any platform, including but not limited to Android, iOS, and associated digital platforms, you ("User") agree to be bound by these Terms and Conditions (the "Terms").

1. Definitions

1. “App” shall refer to the TLA STAR mobile application.
2. “Company" shall refer to TL Astrologer OPC Private Limited, a company incorporated under the laws of India.
3. "User" shall mean any individual or entity accessing or using the App.

2. Eligibility

1. The User represents and warrants that they are at least eighteen (18) years of age and have the legal capacity to enter into these Terms.
2. By using the App, the User confirms that all information provided by them is accurate, truthful, current, and complete. The User is solely responsible for the accuracy of the information provided.

3. User Obligations and Prohibited Conduct

1. The User shall not impersonate any other person or entity or misrepresent their affiliation with any person or entity.
2. The User shall not attempt to reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code of the App or any portion thereof, nor shall the User copy, reproduce, modify, adapt, translate, create derivative works of, distribute, transmit, publicly display, perform, license, sublicense, sell, rent, lease, assign, transfer, or otherwise exploit the App or any content therein, except as expressly permitted by these Terms or with the prior written consent of the Company.
3. The User shall not misuse the App or the platform to propagate misinformation, religious intolerance, hate speech, or any content that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable. The User shall not use the App for any illegal or unauthorized purpose.
4. The User shall not interfere with or disrupt the integrity or performance of the App, or the servers and networks connected to the App. The User shall not attempt to gain unauthorized access to any part of the App, other user accounts, or computer systems or networks.

4. Use of Services

1. The services provided by the App include access to personalized muhurat, planetary guidance, and horoscope-based timing based on the User's provided birth details and current location.
2. The Company reserves the right to modify, suspend, or discontinue, temporarily or permanently, any feature or part of the App and its services at any time, with or without notice. The User agrees that the Company shall not be liable to the User or to any third party for any modification, suspension, or discontinuance of the services.
3. The suggestions and recommendations provided through the App are for informational and indicative purposes only and should not be considered a guarantee of any specific outcome.

5. Subscriptions and Payment

1. All purchases and transactions conducted through the App are processed via PayU or other designated third-party payment gateways and are subject to the terms and conditions and privacy policies of the respective payment service providers. The Company is not responsible for the actions or inactions of such third-party payment processors.
2. Unless expressly stated otherwise, all subscription fees are non-refundable once the payment has been processed.
3. The User is solely responsible for managing and canceling their subscriptions prior to the applicable renewal cycle to avoid incurring further charges. Failure to do so may result in automatic renewal and continued billing.
4. The User acknowledges and agrees that the pricing, features, and subscription options offered may vary between the Android and iOS versions of the App.

6. Intellectual Property

1. All content, algorithms, source code, object code, data, branding, logos, trade marks, service marks, user interface design, graphics, and other intellectual property rights in and to the App (collectively, “Intellectual Property”) are the sole and exclusive property of TL Astrologer OPC Private Limited and/or its licensors and are protected by applicable copyright, trade mark, patent, and other intellectual property laws.
2. The User is granted a limited, non-exclusive, non-transferable, revocable  and license to access, and use the App solely for personal and non-commercial purposes only in accordance with these Terms.
3. The User shall not copy, reproduce, republish, upload, post, transmit, distribute, modify, create derivative works based on, sell, transfer, publicly display, publicly perform, or in any way exploit the Intellectual Property of the Company without the express prior written consent of the Company. Specifically, the User shall not reverse engineer, copy, or reuse the App's structure, rating system, proprietary logic, or any other element of the Intellectual Property.

7. Termination of Access

1. The Company reserves the right to suspend or terminate the User's access to all or any part of the App and/or the User's account at any time, without prior notice or liability, for any reason, including but not limited to the User's breach of these Terms, suspected misuse of the App, or for any other reason at the Company's sole discretion.
2. Upon termination, the User's right to use the App shall immediately cease. Any provisions of these Terms that by their nature should survive termination shall survive, including but not limited to clauses regarding intellectual property, disclaimer of warranties, limitation of liability, and indemnification.
3. The Company reserves the right to discontinue offering the App, or any part thereof, at any time, with or without prior notice.

8. Disclaimer of Warranties

1. THE APP AND ITS CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.
2. THE COMPANY DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE APP OR THE SERVERS THAT MAKE THE APP AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
3. THE COMPANY DOES NOT WARRANT OR MAKE ANY REPRESENTATIONS REGARDING THE USE OR THE RESULTS OF THE USE OF THE APP OR ITS CONTENT IN TERMS OF THEIR CORRECTNESS, ACCURACY, RELIABILITY, OR OTHERWISE.
4. THE COMPANY EXPRESSLY DISCLAIMS ANY WARRANTY OR GUARANTEE THAT ANY ASTROLOGICAL PREDICTIONS OR TIMING RECOMMENDATIONS PROVIDED THROUGH THE APP WILL BE ACCURATE OR WILL LEAD TO ANY SPECIFIC OUTCOME. THE USER ACKNOWLEDGES THAT ASTROLOGY IS NOT AN EXACT SCIENCE AND THAT PREDICTIONS ARE SUBJECT TO INTERPRETATION.

9. Limitation of Liability

1. TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW, IN NO EVENT SHALL THE COMPANY, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES) ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USER'S ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE APP, ANY CONTENT THEREIN, OR THESE TERMS, EVEN IF THE COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
2. THE USER'S SOLE AND EXCLUSIVE REMEDY FOR DISSATISFACTION WITH THE APP OR ANY CONTENT THEREIN IS TO STOP USING THE APP.
3. IN NO EVENT SHALL THE TOTAL AGGREGATE LIABILITY OF THE COMPANY TO THE USER FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE USE OF THE APP EXCEED THE AMOUNT, IF ANY, PAID BY THE USER TO THE COMPANY FOR THE USE OF THE APP IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY.

10. Indemnification

1. The User agrees to indemnify, defend, and hold harmless the Company, its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to (a) the User's access to or use of the App; (b) the User's violation of these Terms; (c) the User's violation of any third-party right, including without limitation any intellectual property or privacy right; or (d) any claim that the User's content caused damage to a third party.

 

11. Governing Law and Dispute Resolution

1. These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.
2. Any dispute, controversy, or claim arising out of or relating to these Terms or the use of the App shall be subject to the exclusive jurisdiction of the courts located in Delhi, India, and the User hereby irrevocably consents to the jurisdiction of such courts.

12. Entire Agreement

These Terms constitute the entire agreement between the User and the Company with respect to the App and supersede all prior or contemporaneous communications and proposals, whether oral or written, between the User and the Company with respect to the App.

 

13. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be struck and the remaining provisions shall remain in full force and effect.

 

14. Waiver

No waiver of any provision of these Terms shall be effective unless in writing and signed by the party against whom the waiver is sought to be enforced. The Company's failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

 

15. Modifications to Terms

The Company reserves the right to modify or update these Terms at any time, with or without prior notice to the User. Any changes to these Terms will be effective immediately upon posting the revised Terms within the App or on the Company's website. The User's continued use of the App after the posting of revised Terms constitutes the User's acceptance of the revised Terms. It is the User's responsibility to review these Terms periodically for any changes.

PRIVACY POLICY

1. Information Collection

1. The Company collects the following categories of personal data from Users:

1. Personal Information: Full Name, Date of Birth, Time of Birth, Place of Birth.
2. Contact Information: Mobile number (solely for One-Time Password (OTP) verification).
3. Location Information: Current city derived from GPS data. Collection of city-level location data is mandatory for the core functionality of providing accurate Muhurat calculations.
4. Technical Information: Device type, operating system version, and application usage patterns, including but not limited to session duration and features utilized (collected through third-party analytics services).

2. The Company may also collect the User's IP address and device identifiers for analytical purposes and to ensure the security and proper functioning of the App.

 

2. Purpose of Collection and Processing

1. The collected personal data is processed for the following specific purposes:

1. To generate personalized astrology-based content tailored to the User's birth details.
2. To display dynamic Muhurat and Hora notifications relevant to the User's current location.
3. To deliver reminders and alerts based on the User's planetary periods and location.
4. To analyze application usage trends and patterns to improve the App's functionality, user experience, and performance.
5. To provide customer support and address User inquiries.
6. To ensure the security and integrity of the App and prevent fraudulent activities.

3. Consent Mechanism

1. By registering an account and using the App, the User provides explicit consent to the collection, storage, processing, and use of their personal data by the Company for the purposes outlined in this Privacy Policy.
2. The User acknowledges that the collection of their city-level location data is a necessary prerequisite for the App's core functionality of providing accurate astrological calculations.

1. The Company unequivocally states that it does not sell, trade, rent, or otherwise disclose the User's personal data to advertisers or other third parties for their direct marketing purposes.

4. The Company confirms that there are no international transfers of User's personal data outside of India.

1. The User's birth details (Full Name, Date of Birth, Time of Birth, Place of Birth) and city location data will be retained for as long as the User's account remains active or as reasonably necessary to provide the services and personalized content, and for a reasonable period thereafter in case the User decides to reactivate their account.
2. Technical data and application usage patterns may be retained for a longer period for analytical and App improvement purposes, in an anonymized and aggregated form.
3. The User has the right to request the deletion of their personal data at any time by contacting the Company via email at the designated contact address. Upon receiving a verified deletion request, the Company will take reasonable steps to erase the User's personal data from its active databases; however, some data may be retained in secure backups for a limited period as required for legal compliance, audit purposes, or disaster recovery.

1. The App does not utilize browser cookies for tracking User activity.

The App requests necessary device permissions, such as access to location services (for accurate Muhurat calculations), permission to send notifications (for reminders and alerts), and potentially access to device storage (if required for specific features like saving reports, with clear user consent). These permissions are requested with clear and explicit prompts to the User and are used solely for the core functionality of the App as described in this Policy. The User can manage these permissions through their device settings.

9. Children’s Privacy

1. The App is not intended for use by individuals under the age of eighteen (18) years. The Company does not knowingly collect personal data from children under this age.
2. If the Company becomes aware that personal data of a child under 18 has been collected without verifiable parental consent, the Company will take immediate steps to delete such information and terminate the associated account.The Company reserves the right to implement age verification measures to prevent access and use by underage individuals.
